Re: [ga] New York State Domain Law

Hi Elliott,

You may have misunderstood Karl's comment. Eliot Spitzer is the current Governor of New York and former New York State Attorney General.

IMO, the legislation was more likely due to a domain registrant registering domains containing some politicians name and then trying to sell said domains to that person. Unfortunately, the actions of the minority group who do not respect intellectual property rights, negatively impact the legitimate rights of the majority of domain registrants who do respect those rights.

I am not a lawyer and these are only my personal opinions. If you require legal advice, you should seek qualified legal counsel.

Sincerely,
Ted

danny, two things. first, I was just joking with karl (in response to his gentle poke). second, this law explicitly does not apply to us and our use of surnames i) because we explicitly do NOT buy them for resale and ii) there is nothing left in the primary market in any event. I understood this law to apply to people doing things like registering the name of brad and angelina's baby.

I think it is just fantastic that this congresswoman has the time and energy to protect unborn celebrities! this looks like a classic piece of "it happened to a friend of her's" legislation.

Elliot,

As I read this law (IANAL), it will only affect about
a dozen ICANN-accredited registrars (but not your firm
as your company is not located within the state --
however it may impact some of your resellers):

4. "In a civil action commenced under this section, a
domain name shall deemed to have its situs within the
state if the domain name registrar, registry, or other
domain name authority that registered or
assigned the domain name is located within the state."
