I don't buy having a policy that regulates business.  If a TLD fails in one instance it can succeed under another business model.  If .COM loses records to registryfly.  Fine.  Obviously the business model does not work.

One of the successes in the inclusive name space was the business model.  It appealed to a broad diversity of corporate buyers who want a hands off approach to policy.  If ICANN kills that policy the "astonishment" factor goes away, replaced with those familiar civil servant words - not our department.  So much of ICANNs ills are it's need to regulate.  Now look at it - a house of cards with no other options.  The chinese have a much better system.
