Jon,
It's fair to ask for a ruling on whether or not
"Direct Transfers" are a Consensus Policy violation.
The intent of the policy, the community will, was to
have a non-renewed domain name return to the pool of
available names upon expiration.
As I see it, registrars have already acted to
circumvent the will of the community and no amount of
discussion will dissuade them from such ongoing
activities as long as they continur to turn a profit.
We can engage in constructive dialogue on how to
repair the damage to the consensus policy process
after we hear ICANN's official view.
