Dear all,

While I appreciate registrar willingness to discuss a
code of conduct, I am keenly aware that the topic of a
Registrar Code of Conduct has been under discussion in
the Registrar Constituency on several different
occasions since mid 2000 without having come into
fruition -- see

At this point I think we need to follow one of these
paths:
(1) trust the registrars to get this done, or 
(2) rely on an approach that has the registries
proactively crafting a Code of Conduct along the lines
of the Eurid Registry model, or 
(3) asking ICANN to adopt a specification establishing
a Code of Conduct for ICANN-Accredited registrars
(that would be put forward for registrar consensus
approval or rejection).

In the meantime, we should be asking ICANN when it
intends to set forth a schedule, terms, or a format
for the escrow arrangement.  Perhaps Roberto can get
back to us with some answers.

The current ICANN Operating Plan cites ICANN Project
IH:  "Develop a registrar data escrow program in
collaboration with the registrar community. Install
and operate the infrastructure needed to escrow data
or contract with an outside entity to provide
technical infrastructure. Create a process for
approving third-party data escrow service providers
and verifying compliance with ICANN's data escrow
policies and procedures."
