Jeff,
just stating as being concerned as to the proposal has some
legal/jurisdiction problems is too little. I would appreciate more
specific questions on specific points as far as I'm able to answer them.
I'm not a law specialist neither do I intend to be. The proposal is
technically/procedurally oriented and as such has nothing to do with
anything else. All that jurisdiction around is another layer and I
strictly distinguish between the two. Jeff, I'm still seeing a
misunderstanding between us regarding this...
I know very well that bringing something like that into life requires
many parties to involve viewing it from different angles and
perspectives. Jefsey has outlined some which I find constructive. I
posted a proposal to the list and everybody can comment it from within
the sphere he/she is strong at, and together, step by step, we can
proceed further. That's all what I can expect.
I don't know who is 'I and our members'. Chris has sent a positive
response, Jefsey the constructive one, and then there are those of yours
somewhat critical. I haven't noticed any other to the merits. Or, have I
missed anything?
As regards the policy, yes, there is an assumption that registrars or
ICANN can enforce it. In contrast to you, I at least believe this is
reasonable to assume. If it wasn't I wouldn't see any remarkable
progress achievable over the issue in comparison to the existing status,
and we could simply forget about the new whois altogether. Just making
cosmetics wouldn't satisfy me.

Great to hear/read here. I hope you understand I am not critical of
what you are proposing only to be critical. I and our members are
concerned as to the proposal draft and your approach from a technical
stand point has legal problems in regards to privacy and security in
different legal jurisdictions. Also it seems that there is an assumption
that registrars or ICANN can enforce whatever Whois policy is eventually
arrived at. We believe and history has shown clearly this is not
reasonable to assume. Hence my original questions regarding enforcement
remain relevant and necessary as to answers.
