I definately lean toward your conclusions. But I have seen where the "parent" Government body invokes it through an agency theory. Though I have not shephardized for appellate cases on the matter. Something sticks in my mind about military government contractors that shields them.
If the DoC were to make the case that interference by the court could "shut down" the net it could be compelling.
