This is part of why expanding namespace, and expanding it in such a way to avoid tm conflicts is important. With generic tlds like com, net, and org, anyone with a tm on any word, whether it should have been granted as a tm in the first place or not, can sue to get the domain name they want.
poetry.org would be less important and possibly not worth suing over if there was a chance to register poetry.pub or poetry.publisher or poetry.foundation
There would be less reason for a panel to find that someone was keeping a legitimate organization from having a viable, legitimate domain name. Two trademark owners wouldn't need to fight over one word in .com, when they can each have their word in different tlds.
