Not everyone takes the time to study up, analyze and apply logical 
corresponding civil duties. Sometimes what would appear to be civil conflict or 
even consistency is simply not correct.
 
For instance: If we have no power and no authority here we owe no duty of 
process as a GA. It does not follow that outside influences do not have a duty 
when interfering. The GA is a body formed with open membership under the 
auspices of the GNSO. The GNSO is an "organization" provided for by the by-laws 
of ICANN which is formed and recognized and contracted with the United States 
of America and fully incorporated and existing within the political and 
geographic body of the State of California, about the 6-8th largest economy in 
the world. The laws and legislative enactments by and for the republican style 
democracy of the State of California govern the activities of said corporation.*
 
So it would seem that Mr. Fowlie, who has no GNSO position and no 
administrative authority, acting on behalf of the Corporation, without by-law 
or statutory right would need to socially justify his action of forbidding a 
certain type of protected speech within the boundaries of California. I believe 
this can be done and that Mr. Beckstrom could probably even do it with an open 
and transparent fiat. But until this is done, Mr. Fowlie appears rather --- 
what is the right word without offending?  I know -- like a stooge. Or maybe 
the term is "tool".
 
*In this case, we the citizens of California pay for the roads, police 
protection, fire protection and subsidize all electricity, water and 
communication infrastructure for ICANN through our taxes yet we do not require 
ICANN to pay taxes here, or Mr. Fowlie to pay state income tax here. In 
exchange we expect ICANN to abide by our laws governing non-profit corporations 
operating and incorporated here.
