Hmm.  In that it is clear that the GNSO council has never ever gone on record 
as participating in any concept of "moderation" of the GA list, this statement 
probably is hedging on misleading -- not in intention but in practice.
 
Myself, JW and Joe Babtista were all moderated off this list.  No one outside 
of this list -  took any responsibility for such action.  It was taken in 
direct violation of our list rules in that the chair in no uncertain terms made 
clear there were to be no suspensions or removals.
 
I do not believe there is any concept of Moderation that is done in secret or 
without accountability.  I have asked 100 times "who in the GNSO moderates this 
list?"

The GNCO Council resolution that refers to acknowledging the charter is 
resolution 20070906-2 
(http://gnso.icann.org/meetings/minutes-gnso-06sep07.shtml).  In the motion 
GNSO encouraged the list's movement toward self moderation and supported the GA 
List in implementing the mailing list rules.  In that motion the GNSO Council 
declined any role in the internal governance of an organizational movement on 
the GA List at that time and restricted the council's actions to issues 
concerning the moderation of the GA List as determined by the by-laws.
