I am dumbfounded, or maybe just dumb ;-}, but i cannot find the Complaint. I know that some lawyers file for some TROs in this manner but it seems weak and displays a lack of transparency. I was nonplussed with the gist of irreparable harm being economic. (sorry but that ain't irreparable, cause money can fix it) Then through the Decs it appeared as though we have a year to decide if the contract should be voided on the public policy grounds. Why wasn't the DOC sued? In fact it would seem a writ of mandate forcing the DOC to dissapprove the contract would be more appropriate; obviously there is an exhaustion of administrative remedy issue.
  But if i were sitting judge i would grant it. Why not until the complaint is responded to and further preparations are made?
  Your thoughts as a practicing Cal. Attorney would be appreciated.
