We refer to the above-mentioned matter and would like to advise you as
follow:&nbsp; <br>
&nbsp;<br>
Minister of Posts &amp; Telematics has just enacted a new regulation on
Internet resources management and usage. According to the
regulations:<br>
&nbsp;<br>
·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>There are five (05)
levels of registrable domain name. The highest level is &quot;.VN? and
used only for the National Authority Organization in Vietnam. The second
level as &quot;COM.VN&quot; for enterprises and commercial firms in
private sector or the name ?PRO.VN? for organizations, individuals
working in professional fields.&nbsp; <br>
</i>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>The
first-to-file rule is adopted. <br>
</i>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <i>Disregard for
domicile and business activities, any Corporation or Individual can be
granted the second level domain name registration upon request.&nbsp;

In practice in Vietnam, some famous domain names and/or trademark of
foreign company(ies) have been unfaithfully registered by Vietnamese
Enterprises as the second level domain name ?COM.VN?.&nbsp;&nbsp;&nbsp;

Vietnam is lacking of legislation for dealing with domain name and
trademark dispute and the awareness and familiarity of the competent
authorities with the trademark and domain name are limited. Therefore it
will be difficult to deal with the dispute.<br>
<font face="Book Antiqua, Bookman">&nbsp;<br>
In the view of above, registration of the second level domain name in
Vietnam is highly recommended for time
being.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <br>
