Eric,
You'll find essentially the same language in all of
the registry contracts as well; below is the clause as
it appears in the .com agreement:
Section 8.5 No Third-Party Beneficiaries.
This Agreement shall not be construed to create any
obligation by either ICANN or Registry Operator to any
non-party to this Agreement, including any registrar
or registered name holder.
