Although in part or rather to a point I agree with the reason(s)
given for this decision, the point to which IP missappropriators
will or can be discouraged is not yet known and as such this decision
only playes into the hands of ACTA proponents. Ergo the consequences
of this decision if considered by other jurisdictions courts at some
future time may have a impact positive or negitive on those courts
decisions. As the US Supreme court is seemingly becoming more interested
in considering such other extra-jurisdictional decisions and/or arguments
there unto pertaining, the implications for ACTA related cases if ACTA
is taken by the USG as a ratified treaty could be effected accordingly.
This therefore brings be back to the considerations dealing with
different types of "Service Providers" in particular Registrars. For
current Registrars in gTLD's under contract to ICANN it would seems that
perhaps Mr. Beckstrom would be well advised to get the SSAC and all
ICANN Accredited Registrars under a enforcable contract that can deal
with these potential considerations.
