I believe it is possible that you misread the quote:
It was that those changes that legal counsel made to the document,
that were purely cosmetic, e.g. commas, spelling corrections,
numbering, expanding Nomcom to Nominating Committee, should just be
accepted.

Also I might add that this was a review we had requested on changes we
were considering as recommendations to the Board. The reason we asked
for the review was to insure that our requested changes were within
the law as understood by ICANN's Legal counsel.

Wow. I think it is great that ICANN thinks that operating within the
law is purely cosmetic.
I sure hope they do not take off their makeup, so we can see what
they are really doing.
