Well is http://www.yelp.com/ now to be considered an "Abusive
Domain Name" or not?
I would say that both parties have a legitimate issue here. Mr./Dr.?
Biegel is rightly that he may have been unduly slandered and is taking
the appropriate legal action to address same. Yet, Mr. Christopher
Norberg may be trying to be a good samaritan in his attempt to inform
the public to the degree he can and knows how, using the Internet as
his means. I hope Mr. Christopher Norberg has the evidence in abundance
to substantiate his complaint and claim towards Mr./Dr.? Biegel... If
not, Mr./Dr.? Biegel will likely prevail and as such it than may become
prudent if not necessary for ICANN to direct to the registrar of
yelp.com to modify whatever policies necessary to vet such complaints in
a manner that is more substancial at a minimum. Otherwise I would
suggest that yelp.com would need to be brought down immediately so that
the public would not be duped or in any small way, misinformed...

sued a local artist over negative reviews published on Yelp, the popular
Web site that rates businesses. Christopher Norberg, 26, of San
Francisco posted the first review in November 2007 after visiting Steven
Biegel at the Advanced Chiropractic Center on Valencia Street. In the
six-paragraph write-up, Norberg criticized Biegel's billing practices
and
said the chiropractor was being dishonest with insurance companies.
...The
Electronic Frontier Foundation, a local nonprofit that supports free
speech
online, is considering helping with Norberg's defense. Matt Zimmerman,
an
attorney with the group, said Biegel will get far more negative
publicity from
filing the lawsuit than from a bad review on Yelp. He said the
foundation
is seeing more and more cases of people trying to use the courts because
they're unhappy with postings on the Internet.
