While it's true that we "should not study the amount of data available for public (anonymous) access for single queries", that does not mean that we can or should ignore what data is made available for "data mining". We are supposed to consider contract changes "to protect domain name holder data from data mining for the purposes of marketing". The most obvious way to do this is to allow the registrants to withhold the data they want protected.
