Dear Michele,

After receiving the RrSG comments provided on 20 January 2016 regarding the Vox Populi request to amend its RRA for the .sucks gTLD(s), ICANN forwarded the RrSG comments to the registry operator.

As you may be aware, Vox Populi and ICANN disagree regarding the approval of Vox Populi’s initial RRA amendment. ICANN maintains the RRA amendment is not approved, and Vox Populi maintains it is approved.  Irrespective of the disagreement, Vox Populi provided the attached letter to address RrSG concerns.

Attached to this message you will find Vox Populi’s response, the initial RRA amendment submission sent to you on 8 January 2016, and the RrSG’s comments.

The RrSG letter had 2 key points of concern: Point 1, regarding sections 2.1 and 3.2, and point 2 regarding section 8.4 of Vox Populi’s RRA. Vox Populi’s attached response proposes to address each point as follows:

1.    Amend section 2.1 to read as follows:
2.1. Purpose. The purpose of this Agreement is to permit and promote offer the registration of domain names in the Vox Populi TLDs and to allow Registrar to offer the registration of the Vox Populi TLDs in partnership with Vox Populi. Neither party shall take action to frustrate or impair the purpose of this Agreement.

2.    Amend section 8.4 to read as follows:
8.4. Amendment in Writing. Vox Populi shall have the right, at any time and from time to time, to amend any or all terms and conditions of this Agreement. Any such amendment shall be binding and effective 15 days after Vox Populi gives notice of ICANN has approved or been deemed to approve such amendment to the Registrar by email. In addition, any new services offered by Vox Populi after the date of execution of this Agreement and approved by ICANN may be subject to additional terms and conditions as may be established by Vox Populi, which terms and conditions shall be deemed accepted in the event Registrar opts to offer such future approved services.

If the RrSG could please review the response and provide any comments to ICANN by responding to this message no later than 23:59UTC on [9 April 2016]. If there is no response by this time, ICANN will assume there are no additional concerns.

Attached, please find the cover letter and the red-lined RRA Amendment for .sucks submitted by Vox Populi Registry Inc. to be shared with your Stakeholder Group.

Per the RRA Amendment Procedure, the RrSG has up to 21 days to review the proposed changes. If the registrars have concerns, please advise ICANN by responding to this message no later than 23:59UTC on 29 January 2016. If there is no response by this time, ICANN will assume there are no concerns and will continue processing the request. If the RrSG responds with concerns, ICANN will continue to the next step of the RRA Amendment Procedure which is to consult with the RrSG and the Registry Operator.
