But still as this is not an ICANN requirement as mentioned by Theresa I really don't see the point to follow it. Would be very intersting to hear from other registrars their position about that subject if they want to see somebody from the constituency or not at the NomCom representing the Registrars.

My personal point of view is that requirement should be an ICANN requirement to avoid to have some constituencies with their participants and other without..which will make the situation unfair. I already know the registry constituency has already decided who they will nominated and I can tell you he will be somebody working for a registry. So here we have 2 solutions: either to coordinate with all the constituencies to make sure everybody follwo the same rule or we can choose to do like some other constituency and to ignore this requirement.

Please find the following in response to your question on what is meant by
the criterion # 4. ICANN expects the NomCom delegates to be independent and not accountable, or beholden, to the constituency that selects them, or to any person, employer,
or organization. This was made clear to all the members of the 2003 NomCom
members, but given that it was the inaugural NomCom, the constituencies
themselves may not have understood this point.

Criterion 4 addresses how the person selected is expected to behave, not who
employs him/her or for whom he/she consults. Those selected by NomCom are
selected in a NomCom group decision, through the development of consensus by
delegates from all constituencies.

Those involved in selecting the delegate may judge that the only way for a
delegate to achieve this independence is by restricting
employment/consultant status, but that restriction is not required by ICANN.

The NomCom takes very seriously its responsibilities to require NomCom
members to disclose actual and perceived conflicts of interest. See the
posted Code of Ethics, and the Charge to the Subcommittee on Conflicts of
Interest. http://www.icann.org/committees/nom-comm.htm     The 2003 NomCom
members disclosed their affiliations and disclosed actual or potentially
perceived conflicts of interest to the Chair and Subcommittee on Conflicts
of Interest. The Subcommittee determined how any disclosed conflicts or
potential conflicts would be handled, including recusal from participation
in discussion and voting. I hope this is helpful.

At its 6 March meeting in Rome the ICANN Board named me to serve as Chair of the 2004 ICANN Nominating Committee (NomCom). Shortly thereafter I selected Pindar Wong to serve as Associate Chair. Working together, Pindar Wong, Linda Wilson (Chair of the 2003 NomCom), and I have been preparing for the work of the 2004 NomCom.

The critical first step in this process is:

* To invite the Supporting Organization Councils/Constituencies and the Advisory Committees to name their Delegate(s)/Liaison to the Nominating Committee in accordance with the ICANN Bylaws. These responses are requested as soon as possible and surely by 11 May 04.

Attached to this letter is the specific request, with further details about what information is needed, to whom the responses should be sent, and to whom questions can be directed. I will greatly appreciate your special attention to the this request, so that the NomCom can begin its tasks promptly. Please review carefully the attachments before making a selection of Delegate(s)/Liaison.

The NomCom will soon be posting further information on its webpage on the ICANN website. We welcome your comments and your assistance in recruiting candidates for these leadership positions.

I look forward to working with the Delegate[s]/Liaison you name for this important undertaking.
