<P>&nbsp; There is no historical "Genesis" that one can factually point
to.&nbsp; Seems that this is a totally new</P>
<P>concept made from whole cloth by ICANN.&nbsp; A very questionable and likely
contrivercial concept.</P>
<P>However now that ICANN is essentially not accountable or soon may be such,
why should they</P>
<P>be concerned about any "Genesis" what so ever? <BR><BR><BR></P>

<DIV>Denise,</DIV>

<DIV>Thank you for your participation on this list where you are not afforded
the protection of layers of bureacracy. Perhaps you can actually make your
clarification somewhat clear. </DIV>

<DIV>What are the other open lists that took the place of the GA?</DIV>
<DIV>&nbsp;</DIV>
<DIV>Where are the archives of the public comments regarding the restructuring
that caused the GA to "cease to exist"?</DIV>
<DIV>&nbsp;</DIV>
<DIV>Where did this reference to "<FONT face=Calibri size=3>cross-constituency"
come from? It was only referenced here by G. Kirokis in 2008.</FONT></DIV>
<DIV><FONT face=Calibri size=3></FONT>&nbsp;</DIV>
<DIV><FONT face=Calibri size=3>But probably and most important, is where did
this legal opinion come from that holds, matters existing prior to but not
mentioned in new "amended" by-laws "cease to exist". This is a very new concept
in jurisprudence and I am sure many would be interested in it's
genesis.</FONT></DIV>
<DIV><FONT face=Calibri size=3></FONT>&nbsp;</DIV>
<DIV><FONT face=Calibri size=3>What appears to be happening is a fine revision
of history.&nbsp; One calculated to get rid of public input without public
comment on the restructuring activities that are nowhere recorded.&nbsp; In
short your "clarification" is a false conclusion.&nbsp; I am sure someone told
you such things but there is absolutely not record that substantiates your
clarification.&nbsp; The only verifiable act or fact is that the new bylaws
neither dispose of or address the GA.</FONT></DIV>

resend my previous email in hopes of clearing up any remaining confusion about
the status of the GA list and its connection with the GNSO. &nbsp;<BR><BR>Under
the current ICANN bylaws, there is no provision for any officers (or
Secretariat) of the GA mailing list, nor any provisions regarding GNSO
responsibility for the GA list. It is not an official structure within ICANN.
&nbsp; Thus, ICANN Staff will not be “preparing a voting booth” or facilitating
any election related to this list (as suggested on this list), nor is the GNSO
responsible for doing so. <BR><BR>For those not familiar with the genesis of
this list, "GA" stands for "General Assembly," which was a structure within the
original DNSO (predecessor to GNSO) that ceased to exist when the DNSO was
restructured into the GNSO years ago. &nbsp; There was an expectation at the
time that the new GNSO would replace the old GA email list with a substantive,
cross-constituency discussion list, but that did not materialize. &nbsp;Several
other mechanisms have been used, instead, to support broad-based GNSO (and
At-Large) discussion. &nbsp; This list was left open, but the GNSO has no
responsibility to maintain it.<BR><BR>Regards,<BR>Denise Michel<BR>ICANN VP
