[council] Legal Memo on IGO Sovereign Immunity
Councilors: As just discussed on the Council call, I am pleased to share the final draft of the legal memo discussing IGO sovereign immunity that was prepared for the IGO CRP WG by Prof. Edward Swaine of George Washington Law School in Washington, DC. As described on the call, our WG will be engaging in a dialogue with Prof. Swaine on Thursday, May 19th; it is also scheduled to have a 75 minute F2F meeting in Helsinki starting at 1:30 pm on Monday, June 27th. As you will see when you review the memo, the degree to which an IGO has immunity is not a simple black and white matter but is in fact a highly complex question -- the answer to which will vary with the type of IGO, the national jurisdiction in which the question is raised, and the activity for which the IGO seeks to assert immunity.
